Know Your Constitution: If You Dont Know Your Rights, You Don’t Have Any Rights!

Your Constitution is an iron clad contract, enforceable in a court of law – Carl Miller

No state may convert a secured liberty into a privilege and issue a license and a fee for it. – Carl Miller

Marbury v. Madison : 5 US 137 (1803):
“No provision of the Constitution is designed to be without effect,” “Anything that is in conflict is null and void of law”, “Clearly, for a secondary law to come in conflict with the supreme Law was illogical, for certainly, the supreme Law would prevail over all other laws and certainly our forefathers had intended that the supreme Law would be the basis of all law and for any law to come in conflict would be null and void of law, it would bare no power to enforce, in would bare no obligation to obey, it would purport to settle as if it had never existed, for unconstitutionality would date from the enactment of such a law, not from the date so branded in an open court of law, no courts are bound to uphold it, and no Citizens are bound to obey it. It operates as a near nullity or a fiction of law.”

(If any statement, within any law, which is passed, is unconstitutional, the whole law is unconstitutional.)

History is clear that the first ten amendments to the Constitution were adopted to secure certain common law rights of the people, against invasion by the Federal Government.”– Bell v. Hood, 71 F. Supp., 813, 816 (1947)  U.S.D.C., So. Dist. CA.

‘Shadow’ Government Demonizes Veterans as ‘Terrorists’ Out of Fear of a New ‘Battle Of Athens’

” The Battle of Athens was an armed revolt that gained national attention. Attempting to end the control of an entrenched political machine, World War II veterans used force to ensure that on the day of local elections in 1946 every vote “was counted as cast.” After local authorities locked themselves and the ballot boxes in the jail, veterans suspicious of foul play gathered weapons and ammunition and exchanged fire from this hill upon the jail, which once stood across the street. The besieged authorities surrendered. At a meeting in the courthouse, an interim government was set up, followed by the election of the veterans’ slate.”  (source)

The Battle Of Athens

The Daily Post-Athenian, Athens, Tenn., August 7, 1946; pages 1, 6.

McMinn A Warning — By Eleanor Roosevelt

New York, Monday — After any war, the use of force throughout the world is almost taken for granted. Men involved in the war have been trained to use force, and they have discovered that, when you want something, you can take it. The return to peacetime methods governed by law and persuasion is usually difficult.

We in the U.S.A., who have long boasted that, in our political life, freedom in the use of the secret ballot made it possible for us to register the will of the people without the use of force, have had a rude awakening as we read of conditions in McMinn County, Tennessee, which brought about the use of force in the recent primary. If a political machine does not allow the people free expression, then freedom-loving people lose their faith in the machinery under which their government functions.

In this particular case, a group of young veterans organized to oust the local machine and elect their own slate in the primary. We may deplore the use of force but we must also recognize the lesson which this incident points for us all. When the majority of the people know what they want, they will obtain it.

Any local, state or national government, or any political machine, in order to live, must give the people assurance that they can express their will freely and that their votes will be counted. The most powerful machine cannot exist without the support of the people. Political bosses and political machinery can be good, but the minute they cease to express the will of the people, their days are numbered.

This is a lesson which wise political leaders learn young, and you can be pretty sure that, when a boss stays in power, he gives the majority of the people what they think they want. If he is bad and indulges in practices which are dishonest, or if he acts for his own interests alone, the people are unwilling to condone these practices.

When the people decide that conditions in their town, county, state or country must change, they will change them. If the leadership has been wise, they will be able to do it peacefully through a secret ballot which is honestly counted, but if the leader has become inflated and too sure of his own importance, he may bring about the kind of action which was taken in Tennessee.

If we want to continue to be a mature people who, at home and abroad, settle our difficulties peacefully and not through the use of force, then we will take to heart this lesson and we will jealously guard our rights. What goes on before an election, the threats or persuasion by political leaders, may be bad but it cannot prevent the people from really registering their will if they wish to.

The decisive action which has just occurred in our midst is a warning, and one which we cannot afford to overlook.

Duck Hillary! Throwing Shoes At Politicians

Throwing Shoes as an insult or protest gets attention when the target is a politician. In an unscripted moment, this week, a woman threw a shoe at Hillary Clinton.

Remember the Iraqi journalist, Muntader al-Zaidi, who threw his shoes at George Bush in 2008?

In Arabic, Mr. Zaidi shouted:“This is a gift from the Iraqis; this is the farewell kiss, you dog!” as he threw a shoe at Bush.

Launching the other shoe he shouted:“This is from the widows, the orphans and those who were killed in Iraq!”

In October 2013, the President of Taiwan, Ma Ying-jeou faced some flying shoes.

The China Post reported:

“Of late, President Ma Ying-jeou has been dogged by flying shoes thrown at him by protesters and hecklers, so frequent and threatening that Taiwan’s police spent about US $16,000 to buy 149 “shoe-catching nets” to protect the safety of the president, although none of these projectiles has yet hit the bull’s-eye.”

Maybe, ‘shoe-catching nets’ will, shortly, be part of security at American political events.

Is Ai Weiwei A Dangerous Man?

“There are no outdoor sports as graceful as throwing stones at a dictatorship…”

“Choices after waking up: 1. To live or to die? 2. To be true or to lie? 3. To be lively or to decay? 4. To live or be forsaken? 5. To be wise or to be idiotic? 6. To smile or to be humiliated? 7. To denounce or to celebrate? 8. To be more courageous or to be more fearful? 9. To take action or to be brainwashed? 10. To be free or to be jailed?

And one for luck.”              (Ai WeWei’s Top 10 Tweets)

Imagine A Time When America Is Again Governed By The Constitution

Rand Paul:

“Imagine with me for a moment, imagine a time when liberty is again spread from coast to coast. Imagine a time when our great country is again governed by the Constitution. Imagine a time when the White House is once again occupied by a friend of liberty. You may think I’m talking about electing Republicans. I’m not. I’m talking about electing lovers of liberty.

It isn’t good enough to pick the lesser of two evils. We must elect men and women of principle, and conviction and action, who will lead us back to greatness.”

“Our rights are inherent. They are inseparable from our person. Our rights are innate, they come from our Creator and no government can take them away from us.

The Constitution merely codifies what exists before all time. Mr. President, we will not let you run roughshod over our rights. We will challenge you in the courts. We will battle you at the ballot box. Mr. President, we will not let you shred our Constitution.

Our future hangs in the balance. ”

Man Dumps Tons Of Manure In Front Of French Parliament

A brave frenchman, responding to a new tax, gave new meaning to the phrase ‘dirty politics’ when he dumped several tons of horse manure in front of the Palais Bourbon, home of the French National Assembly.

“Out with Hollande and the entire political class. Long live the Sixth Republic,”  was the message on the side of the truck.

A Free Press is The Most Dangerous Foe Of Tyranny

“A free press is the unsleeping guardian of every other right that
free men prize; it is the most dangerous foe of tyranny.… Under
dictatorship the press is bound to languish, and the loudspeaker
and the film to become more important. But where free institutions
are indigenous to the soil and men have the habit of liberty, the
press will continue to be the Fourth Estate, the vigilant guardian
of the rights of the ordinary citizen.”  —  Sir Winston Churchill

History Of The Free Press

The Fourth Estate
Toward the end of the eighteenth century, Edmund Burke, theorist of the English constitution, rose in Parliament to talk about a new player in democracy – a fourth estate. Thomas Carlyle reported Burke’s comments:

“Burke said there were Three Estates in Parliament; but in the Reporter’ Gallery yonder, there sat a Fourth Estate more important than they all. It is not a figure of speech, or a witty saying; it is a literal fact – very momentous to us in these times. Literature is our Parliament too. Printing, which comes necessarily out of Writing, I say often, is equivalent to Democracy; invent Writing, Democracy is inevitable … Whoever can speak, speaking now to the whole nation, becomes a power, a branch of government, with inalienable weight in lawmaking, in all acts of authority. It matters not what rank he has, what revenues or garnitures: the requisite thing is that he have a tongue which others will listen to; this and nothing more is requisite. The nation is governed by all that has tongue in the nation. Democracy is virtually there.”
